What Are Modal's Disclaimers In Checkout? – Modal

Overview

Every page in Modal Checkout will display a default disclaimer at the bottom of the Checkout window. The disclaimer goes over the terms and conditions of the offers and prices being shown.

Order of Disclaimers:

1. Finance / Lease / Cash Disclaimers

This disclaimer notes the exact terms, monthly payments, and down payment currently configured in Modal Checkout. The values in the text will update in real-time when a user switches between Finance, Lease, Cash, or when the payment calculator configurations are adjusted. The text is dependent on if the Payment Calculator is receiving valid rates from our third-party services.

Finance Disclaimer with valid rates:

"Estimated payments are based on 2.90% APR for 72 months at $15.15 per month per $1,000 financed and $4,400 down."

Lease Disclaimer with valid rates:

"Lease payments are based on 36 monthly payments of $192 with $2,200 down payment."

Finance Disclaimer without valid rates:

"Loan payment to be confirmed by dealer"

Lease Disclaimer without valid rates:

"Lease payment to be confirmed by dealer"

Cash Disclaimer with or without valid rates:

None

2. Global Disclaimer

This global disclaimer is displayed on all vehicles. This text will not update when a user switched between Finance, Lease, Cash, or when the payment calculator configurations are adjusted.

"The offered terms are based on the information you provided and may change if you are unable to provide the documents we require. The terms also may change if you update any information on our website or at the dealer. The Total cost of the car you selected and any ancillary products, fees and taxes included in your offer may not include all of the options you select at the dealer and associated taxes, tag, other governmental fees, dealer service charges and title service fees. If any of these amounts change, they will correspondingly change the terms of the financing and payment you selected. The terms provided do not constitute a contract, a purchase proposal, nor a purchase order. Neither you nor the dealership is bound to buy, sell or lease a vehicle until both parties have signed a contract and the transaction is consummated. Special Offers are subject to eligibility restrictions and some offers cannot be combined. Final offer eligibility will be confirmed by the dealer."

3. Trade Disclaimer (if applicable)

This trade disclaimer is displayed on all vehicles when a user has added a trade-in vehicle. The text will not update regardless of a vehicle trade-in or a lease trade-in.

"The estimated value of your vehicle is subject to visual inspection and confirmation of vehicle history, mileage, and equipment. If you trade in your current vehicle, any amount you owe which is more than the amount allowed on your trade-in will be added to the new amount financed subject to credit approval. If you return your leased vehicle to the leasing company, you will be responsible for any payment obligations under your current lease."

4. Custom Dealer Disclaimer (if applicable)

Your dealership also has the option of adding their own custom disclaimer to Modal Checkout. The text of your custom disclaimer can be configured during the onboarding process or set later through a support ticket.
